Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of the playwithmybot.com website and the e-Ssistant AI assistant and related setup, automation and support services (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you confirm you have authority to bind that business, and "you" means that business. If you have a signed proposal or service agreement with us, that document controls wherever it conflicts with these Terms.

2. Who we are

The Service is provided by Play With My Bot ("Play With My Bot", "we", "us" or "our"). You can reach us at ryan@baggottsbots.com or (843) 505-1657. Parts of the Service are built on technology from third-party providers, including PayMeGPT. Your relationship for the Service is with us, so contact us about your account, billing or support.

3. The Service

e-Ssistant is a custom AI assistant we set up for your business. Depending on what we agree with you, it may respond to emails and direct messages, send and receive SMS, answer phone calls with an AI voice, book appointments, send reminders, qualify leads and send follow-ups.

We may add, change or remove features over time. Beta or preview features are provided as is and may be discontinued.

4. Eligibility and access

• You must be at least 18 years old to use the Service.
• You agree to give accurate information and keep it updated.
• You are responsible for keeping any logins secure and for activity under your account, including activity by people you give access to.
• Tell us right away if you suspect unauthorized access.

5. Fees and payment

• Fees. Fees, billing dates and included usage are set out in your proposal, order or checkout page.
• Usage charges. Messaging, calling, phone numbers and AI usage may be charged by usage where your plan says so.
• Refunds. Unless your agreement says otherwise, fees are non-refundable, including for partial periods or unused features.
• Cancellation. Unless your agreement says otherwise, you may cancel at any time and keep access through the end of your current billing period.
• Payment processing. Payments are handled by third-party processors. We do not store your full card details.
• Taxes. Fees exclude applicable taxes, which are your responsibility.

6. Third-party services

The Service connects to third-party services such as AI model providers, telephony and messaging carriers, social networks, calendars and payment processors. Your use of those services is governed by their own terms, which you must follow. You are responsible for charges those providers bill to you directly. We are not responsible for their availability or accuracy, or for changes they make that affect the Service.

7. Messaging and calling compliance

You are the sender of messages and calls made for your business through the Service, and you are responsible for following the laws and carrier rules that apply, including the TCPA, CAN-SPAM, state telemarketing and AI-disclosure laws, privacy laws, carrier A2P 10DLC and toll-free registration requirements, and Meta and WhatsApp business messaging policies. You agree to:

• Get and keep records of valid consent before sending marketing texts, emails or calls, or using automated or AI voices.
• Honor opt-out requests, such as STOP or unsubscribe, promptly.
• Identify your business in your messages and only message during permitted hours.
• Not use purchased, rented or scraped contact lists.

We may block or delay messages, or suspend messaging features, if we see high complaint rates, carrier violations or suspected abuse. Carrier fees and fines caused by your messaging are your responsibility.

8. AI-generated content

• AI output can be inaccurate, incomplete or offensive. You are responsible for reviewing it and for what your assistant says or does on your behalf, including bookings, quotes and promises to your customers.
• Do not rely on AI output as professional legal, medical, financial or other regulated advice.
• You must tell people they are interacting with an AI where the law requires it.
• As between you and us, you own the output generated for you, subject to third-party rights and the terms of the underlying AI providers.

9. Acceptable use

You may not use the Service for any illegal purpose, or for:

• Fraud, phishing, scams or other deceptive practices.
• Distributing malware or other harmful content.
• Violating intellectual property rights.
• Harassing, abusive, hateful or harmful communications, or spam.
• Interfering with the operation or security of the Service.
• Collecting personal data of others without consent, or violating data protection laws.
• Impersonating any person or business, or creating fake reviews or records.
• Creating or sharing sexual content involving minors, non-consensual intimate imagery, or deceptive deepfakes or AI voices of real people without consent.

10. Your content

You keep ownership of the content you provide. You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, translate and distribute it only as needed to provide the Service. You confirm you have the rights needed to give us that content.

11. Data protection responsibilities

If the Service handles personal data of your customers or leads on your behalf:

• You are the data controller for that data, and we act as a data processor.
• You are responsible for obtaining the necessary consents.
• You will comply with applicable data protection laws, including GDPR and CCPA.
• You will respond to data subject requests in a timely manner.

12. Our intellectual property

The Service, the e-Ssistant and Play With My Bot names, and their content, features and functionality are owned by us and our licensors and protected by intellectual property laws. These Terms do not transfer any of those rights to you.

13. Suspension and termination

We may suspend or end your access to the Service, without prior notice or liability, if you breach these Terms or if we need to in order to protect the Service, other users or the public. You may stop using the Service at any time by contacting us. After termination, we handle your personal data as described in our Privacy Policy.

14. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that messages or calls will be delivered, that AI output will be accurate, or that you will achieve any particular business result.

15. Limitation of liability

To the fullest extent permitted by law, in no event shall Play With My Bot or its owners, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of, or inability to use, the Service.

16. Indemnification

You agree to indemnify and hold harmless Play With My Bot from any claims, damages or expenses arising from your violation of these Terms or your use of the Service, including your messages, calls and AI assistant.

17. Governing law and disputes

These Terms are governed by the laws of the United States and the State of South Carolina, without regard to conflict-of-law provisions.

Any dispute arising from these Terms or your use of the Service will first be addressed through good-faith negotiation. If it cannot be resolved that way, it will be settled by binding arbitration under the rules of the American Arbitration Association.

18. Changes to these Terms

We may modify these Terms at any time. We will post the new Terms here with an updated "Last updated" date and give notice of significant changes by email where we have your address. Continuing to use the Service after changes means you accept the new Terms.
