1. Introduction

Play With My Bot ("we", "our" or "us") provides e-Ssistant, a custom AI assistant that answers leads for businesses. This Privacy Policy explains how we collect, use, share and protect information when you visit playwithmybot.com, contact us, use e-Ssistant, or talk to an e-Ssistant assistant. It should be read with our Terms of Service.

2. Who is responsible for your data

We are the data controller for personal data we collect about our website visitors, leads and clients.

When e-Ssistant talks to people on behalf of one of our clients, that client is the data controller and we act as a data processor. If you interacted with a business that uses e-Ssistant, contact that business first about your data.

3. Information we collect

Contact form data: name, email, phone number, company and any message you send us.
Client account data: business details, login details and the information used to set up your assistant.
Payment data: billing records. Card details are handled by our payment processor, and we do not store full card numbers.
Conversation data: emails, SMS, direct messages, call recordings or transcripts where enabled, and appointment details exchanged with an e-Ssistant assistant.
Connected account data: information from accounts connected to the Service, such as Instagram, Facebook Messenger or calendars, limited to what is needed to run the features turned on.
Technical and usage data: IP address and the approximate location derived from it, browser type, device information, cookies and how pages are used.

4. How we use information

To provide and maintain the Service and respond to your requests.
To answer messages and calls, book appointments, send reminders and follow up.
To process payments and manage client accounts.
To improve the Service and understand how it is used.
To send marketing communications, only with your consent where the law requires it.
To prevent fraud, keep the Service secure and comply with legal obligations.

5. Legal basis for processing (GDPR)

Contract: processing needed to provide the Service to you.
Legitimate interests: responding to enquiries, improving the Service, and preventing fraud.
Consent: where you opt in to marketing or non-essential cookies.
Legal obligation: to comply with applicable laws.

6. Service providers

We do not sell your personal data.

We share personal data with service providers that help us run the Service. Some are always used, and others only when the related feature is turned on:

Platform: PayMeGPT, which hosts the assistants, forms and related data, along with its infrastructure providers.
Website hosting: GitHub Pages, which serves this website.
AI model providers: such as OpenAI, Anthropic, Google, xAI, Groq and DeepSeek, depending on the model used. These may be located in the United States or, for DeepSeek, China.
Email, SMS and voice: such as Amazon Web Services, Twilio and ElevenLabs.
Messaging and social channels: such as Meta (Instagram, Facebook Messenger, WhatsApp), for channels connected to the Service.
Payments: such as Stripe.
Analytics: such as Google Analytics, where configured, and IP-based location services.

We may also disclose information if the law requires it, to protect rights and safety, or as part of a business transfer.

7. SMS and mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties, except service providers that help us deliver messages.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.

8. Data retention and deletion

Client account data: kept while your account is active, plus 30 days after a deletion request.
Chat and conversation data: kept for up to 2 years or until deletion is requested.
Payment records: kept for 7 years, as required by tax and accounting rules.
Analytics data: aggregated or anonymized after 26 months.
Marketing consent records: kept for 3 years after your last interaction.

9. International transfers

Your data is mainly processed in the United States. Depending on the AI models and channels in use, some data may be processed by providers elsewhere, including China for certain AI models. For transfers from the EEA or UK, we rely on appropriate safeguards such as Standard Contractual Clauses.

10. Cookies

Essential cookies: needed for the site to work.
Analytics cookies: help us understand how the site is used, with consent where required.
Marketing cookies: used for advertising, with consent where required.

11. Your rights under GDPR

If you are in the EEA or UK, you have the right to access, correct or delete your personal data, restrict or object to how we process it, receive it in a portable format, withdraw consent at any time, and complain to your local data protection authority.

12. Your rights in California

California residents have the right to know what personal information is collected and how it is disclosed, to request correction or deletion, to opt out of any sale or sharing, and not to be discriminated against for using these rights. We do not sell your personal information.

13. Data security

We use technical and organizational measures to protect your information, including encryption in transit and access controls. No method of transmission or storage is 100% secure. If a data breach affects your personal data, we will notify you and the relevant authorities as the law requires.

14. Automated processing

e-Ssistant uses AI to respond to messages and calls and to qualify leads. We do not make decisions with legal or similarly significant effects on you based solely on automated processing. You can ask for a human to review any AI-related decision.

15. Children

The Service is not intended for children under 16, and we do not knowingly collect their personal information. If we learn we have collected data from a child under 16, we will delete it promptly.

16. Changes to this policy

We may update this Privacy Policy from time to time. We will post the new policy here with an updated "Last updated" date and notify you of material changes where the law requires it.
